    I HAVE LIVED IN SPAIN FOR 5 YEARS, OWN MY HOUSE ME AND MY SPOUSE, PAY MY TAXES, IF ANYTHING HAPPENED TO ANYONE OF USE DO WE HAVE TO PAY ANY TAXES AND WHAT HAPPENS IF WE HAVE TO PAY IF WE DO NOT HAVE ANY MONEY BUT OUR PENSIONS

    WE HAVE LIVED IN SPAIN MY HUSBAND AND I FOR 5 YEARS, WE OWN OUR HOUSE AND WE ARE RESIDENTE WE ARE STRICTKY LEGAL MY SPANISH STANDARDS, MY HUSBAND IS A PENSIONER, I AM 2 YEARS OF RETIREMENT AND UP TO THIS POINT I AM ON INCAPACITY

    Dear Jan

    If you have not registered as fiscal (tax residents) in Spain the survivor will have a tax bill based on 50% of the value of the property. If you have registered then there will be a reduction of 99% on the amount payable, which will be a nominal sum. I will need more information to advise you of the figures

    dear sir
    we have lived in fuerteventura canary islands for 5 years and own our property outright. i am 65 and my wife is 61. we both have residencia cards but are not registered as fiscal residents.can you please clarify whether we will pay capital gains tax on the sale of our house also our inheritance tax liability

    If Fuerteventura falls under Agencia Tributaria rules from Madrid, then as “non fiscal residents” Capital gains tax will be payable on sale of your main residence. Additionally on first death IHT will apply to the value of the deceased partner’s half of the property, less any loans/mortgages on the property.
